From Third-Party Ownership to Murky Transfers

In September of 2015, a website known as Football Leaks went live and almost immediately, controversy followed. The goal of Football Leaks is to shed light on the backroom dealings, controversial transfers and business agreements that often overshadow performances on the pitch. The website is operated semi-anonymously out of Portugal using Russian servers, with the only known operator going solely by John — who agreed to speak with The New York Times last month. In its most notable document release, Football Leaks published documents linking Dutch Club FC Twente to an investment firm called Doyen. The documents outlined agreements of TPO, or third-party ownership, in which Doyen loaned FC Twente $5.5 million in exchange for the economic rights to five players — including Dušan Tadic, who was later sold to England’s Southampton Football Club for over $16 million. Such dealings were legal at the time, though frowned upon, but are now outlawed by FIFA.

This past Saturday, Football Leaks posted the complete €50 million transfer agreement between French Ligue One’s AFC Monaco and England’s Manchester United for the wonder-teenager Anthony Martial. At the time of the transfer, Martial was only 19 years old. What was previously unreleased to the public were three clauses in the contract entitling Monaco to another 30 million euros if Martial makes the scoresheet 25 times (he currently has eight goals), makes 25 appearances for the French national team (he already has three caps) and if he is nominated for the Ballon d’Or (FIFA‘s player of the year) — none of which are out of the question. If he reaches these stats while at United, it would make him the fifth-most-expensive player in the world, aged only 20, surpassing Real Madrid’s James Rodriguez, who also came from Monaco.

For many of these clubs, billions of dollars are on the line. Most walk the straight and narrow, abiding by FIFA’s laws. Some, though, will do whatever it takes to achieve success and often operate outside of these laws. Football Leaks is helping to shed light on these deals and make the often cloudy world of soccer transfers and outlawed TPO dealings more transparent. Following the FIFA scandals with Sepp Blatter, the Greek football club Olympiakos FC scandal early last year and the infamous Italian match-fixing scandals of 2006, it is a welcome step to help the world’s most beautiful game become beautiful again — on and off the pitch.

Football Leaks have done it again! And, this time the website dedicated to publishing football contracts and the shady deals and clauses behind them have released a mega deal.

Late on Wednesday evening, Football Leaks published the full transfer documents of Gareth Bale’s move from Spurs to Real Madrid in the summer of 2013.

 Under Real Madrid’s preferred payment plan, Bale’s cost was €99.749,542 (plus a €1,015,875 contribution).

In total Real Madrid will pay Spurs €100,759,418 for Gareth Bale.

Real Madrid have previously claimed that the fee for Gareth Bale was 91 million euros, this leaked document proves that it was over 100 million and that the Welshman cost Los Blancos more than Cristiano Ronaldo.

Under the contract, which is six pages long and signed on August 31, 2013 by Tottenham chairman Daniel Levy, and the general manager of Real Madrid, Jose Angel Sanchez, Bale’s public price was set at 91,589,842 euros.

According to paragraph 15 of the agreement, Real Madrid and Spurs agreed to publicise that the deal was for 78 million pounds (91,589,842 euros). And, that only Real Madrid would be able to announce a fee.

Real Madrid were offered a number of payment methods in Gareth Bale’s contract – they could pay Tottenham €87 million up front for Bale & get a discount or pay (as they have) in instalments with the cost being increased to over €100.8m.

According to Football Leaks, Bale’s cost will be paid in four instalments by Los Blancos -three of €24.9 million have already been paid. One of €21.2 million is pending.

Clause 16 in the contract is also pretty intriguing with Gareth Bale banned by Real Madrid to say anything negative about Spurs, the board of any employees of the north London club.

Clause 4 of the contract sees Real Madrid waive all fees owed on the Rafael van der Vaart transfer which was agreed with Spurs in summer 2010.

The Dutch playmaker moved for a fee believed to be around 10.3 million euros and it seems likely, judging by how most football transfers work, that Tottenham had already paid three instalments on this by the time Bale moved.

For Tottenham fans, the most intriguing clauses come at number 10 and it again shows the genius of Daniel Levy.

Real Madrid must inform Spurs should another Premier League club make an offer for Bale they intend to accept.

Spurs will have first option to match any Premier League offer for Bale within 72 hours even if the original bidder returns with a higher offer.

The option for Spurs to re-sign Gareth Bale only lasts until June 30, 2019 & doesn’t apply should a non Premier League club make an offer.

Football Leaks has uploaded transfer details on Hulk’s move from FC Porto to Zenit—the striker moved from Portugal to Russia in September 2012 in a transfer that according to transfermarkt.de was worth €55 million (find the contract here)—as well as the transfer of the Argentinian defender Ezequiel Garay—the defender was transferred from Benfica Lisbon to Zenit for €6 million in the summer of 2014 (find the contract here).

Hulk’s transfer agreement between Porto and Zenit highlights that Zenit paid a total of €40 million (in three instalments) for the player. Furthermore, Porto included a clause that would see the Portuguese club receive 10% of a future transfer if Zenit sells Hulk for more that €70 million.

The transfer also exposed the influence of Gazprom on the day to day operations of the club, as Porto requested a COMFORT LETTER from JSC Gazprom acknowledging that the gas company would guarantee the sum in question, and “acknowledges the terms and conditions of the present Transfer Agreement and assures to FC PORTO SAD the timely and total obligations of FC ZENIT established in the hereunder agreement.”

In the case of Garay’s transfer from Benfica Lisbon to Zenit, transfermarkt.de was correct in that the transfer was indeed worth €6 million. Unlike the Hulk transfer Gazprom did not need to write a guarantee, which is likely due to relatively low transfer sum.

Eliaquim Mangala cost Manchester City a staggering £41.9million, leaked transfer documents reveal.

 

The website Football Leaks has published what appears to be an authentic transfer agreement between City and Porto of the defender’s move in 2014.

It reveals that the Premier League club paid far in exceed of the £32million they originally claimed they had paid for the France international.

Mangala’s fee comfortably trumps the £33million Manchester United paid for Rio Ferdinand in 2002 to make him the most expensive defender in Premier League history.

 

According to the document, which appeared online on Wednesday, Porto only owned 56.67 percent of Mangala’s economic rights.

The remainder was split between The Doyen Sports Investment Limited, who owned 33.33 percent, with another 10 percent belonging to an Austrian marketing company.

 

City had to pay £23.4million for Porto’s share alone, meaning the remainder of the deal took the total to £41.9million.

There were suggestions the defender was offered to Valencia on a two-year loan deal as part of the agreement to bring Nicolas Otamendi to the Etihad in August – a move the player rejected.
