Information relating to three judge-led inquiries, including two fatal police shootings, have gone missing in the post, the Ministry of Justice has admitted.

 

Two computer discs containing documents about the Mark Duggan, Azelle Rodney and Robert Hamill inquiries have been lost since early January.

 

The loss is particularly sensitive because the fatal police shooting of Mark Duggan triggered the August 2011 riots, which caused hundreds of millions of pounds of damage across England.

 

The inquest into Mr Duggan's death involved a number of firearms officers giving evidence anonymously to protect them from possible retribution.

 

It was not immediately clear whether the officers' names were contained in the lost files - along with names of other sensitive witnesses - but the MoJ said police forces had been warned about the error so they could take "any steps necessary to ensure the protection of officers".

 

In a statement, the MoJ said it had launched an investigation in to the security breach, which it said had taken place contrary to guidelines.

 

"The Government takes information security extremely seriously, and this incident is a breach of the arrangements that should be in place," said a statement to MPs.

 

"At this stage there is no evidence to indicate that the information loss arose from malicious intent.

 

"Nevertheless, it is essential to take the most precautionary view and to take all necessary steps to safeguard the interests of anyone whose information could be disclosed.

 

"Police and other agencies have undertaken their own risk assessment, and have identified and taken any steps necessary to ensure the protection of officers."

 

It said the Rodney, Hamill and Duggan families and the three judges who conducted the inquiries and inquest have been informed, along with the Information Commissioner’s Office, which deals with breaches of the Data Protection Act.

 

Mr Rodney was also shot dead by police, in 2005. A police marksman is due to face trial for murder later this year.

 

In the third case in which files have disappeared Mr Hamill, a Roman Catholic, was beated to death by a Protestant crowd in Northern Ireland in 1997.

 

An inquiry into the incident has yet to publish its report.

 

The MoJ statement went on: "Government officials became aware on January 8 that two discs containing documents relating to these inquiries were missing, having been dispatched by post.

 

"Immediate steps were taken, including intensive searches to locate the discs.

 

"These searches continue, with police assistance. The discs have not, as yet, been found.

 

"Treasury Solicitor’s lawyers were commissioned to undertake a review of all the documents in question, to identify any confidential or sensitive information relating to individuals or agencies and enable any risks to be assessed.

 

"Individuals will be contacted, where appropriate, to inform them of any personal information relating to them.

 

"As well as safeguarding individuals’ interests, the government has undertaken urgent investigations into how this incident was able to happen, and further investigations continue in relation to both the conduct of individuals and the organisational safeguards against information security breaches of this kind."

 

The investigation could lead to disciplinary action, it said.
