I Have used reasonable self defence

Yesterday, had a mate over and we were having a few drinks before we were due to go out. He accidentally smashed pint glass on the floor and twice refused to pick it up, so when i started to, he  picks up the main base and draws it back in his arm at head height asking if i wanted it.

 

Obviously i thought he would possible attack me with it at this point so i grab his arm that the glass is in and twisted it behind his back, making him turn around so he would drop the glass. He still refused to so i put my other arm on the back of his neck whilst iv got his arm behind his back - hes facing away from me at this point - and i force him to the floor.

 

On doing this he crashes through a wooden chair to the ground and i then escort him out the house.

 

He rings me saying iv fractured his rib, with a doctors record, and hes going to get me arrested for abh.

 

I think i used a justified level of force/self defence in my own home, what do u lot think? (we had both had 3 drinks)

now enemies, we were mates.

 

Didnt hit him at all just restrained him on the ground and he then stayed out of my house.

 

I wouldnt be done for assault or abh would i surely? Im defending myself in my own home against someone who i thought was about to attack me with a glass, whilst he was under the influence of alcohol so i had to disable him.

Ye but why did you think he was gonna glass you?

 

because as i was clearing up, he held it up at head height, with his arm pulled back no more than 2 foot away and said do u want it. Hes known for being unpredictable esp. when under the influence of alcohol. Should have realised this beforehand but felt sorry for him as his mums just passed and isnt taking it well so invited him over instead of him drinking himself into oblivion on his own.

 

seydou- we have had minor scraps before and always made up with no police involvment but hes no longer a mate if hes going to try that.

bruv! how he not apologising and picking up the glass?!?

 

but ur calling him ur mate, either uve just excepted the fact that hes a c*nt of a friend or ur not that close, or maybe he just cant the take the drink and got gassed

 

 

either way, he should of got a hot box to the chinh before u chucked him out

combination of the third option and me feeling sorry for him knowing hes going through certain problems and being too soft on him.

 

i know people are saying hit him but im staying in my fathers house whilst hes travelling and dont want the place smashed up due to a living room brawl and i dont want the nosey neighbours calling the police and them contacting my dad abroad. Also dont want a glass in my throat.

 

From the facts i have given, would the majority agree i used a justifiable level of force in the circumstances?
