In theory if you take out a contract and pay for the handset and they then change the terms of the contract can't you just say 'that's not what I signed up for' and then leave the contract?

Yup but as someone pointed out earlier, the contract probably says with regards to your internet usage/airtime, 'terms subject to change'.

I took out a three contract for the iPhone while the cap was 1gb. They have now scrapped it. Does thAt mean I can phone up three and ask them to remove the cap?

you can ask them and they might do it, but its in your contract so they can say no
