It was probably put forward by the girl's defence (Chelsea) that the knife wasn't hers, and that she felt she would be stabbed herself because the two girls were having a scuffle that was so volatile, anything could have happened, in other words it was either her or the other girl. They probably backed this argument based on the dead girl's propensity to do such a thing (her nickname was "pitbull" for instance, which doesn't indicate an angel) and perhaps other things she's done/said etc. All this lead the jury to believe that it actually was an act of survival.

c/sWhether or not the knife was hers is irrelevant imo because she then used it knowing it would cause serious injury.What makes it worse is that the other girl didn't have a weapon so her case that she did it as an 'act of survival' is debatable.

That's for the jury to decide. And yes, there are numerous instabilities with jury trials, but that's how the criminal justice system has worked for centuries. Also, don't take what I said as gospel. The defence would have been ten times more sophisticated and rational than the way I put it. I just tried to bring it low because I couldn't be bothered to type longness. Go and see a trial if you want to see how it works.Self defence is an absolute defence that if proven beyond reasonable doubt, will result in acquittal.Incidentally, I urge any doubter of the criminal justice system to actually go and watch a serious murder trial if possible. I guarantee you you will leave having more faith in the system. It's not about being ignorant of the democratic structures that keep the law in place. Believe you me, the judiciary and judicial system is FAR more open than the system of parliamentary democracy.
