He didn't rape her, in the lowest forceful way, no. But he took advantage of her, no doubt about it, so for that's reason alone he is a wrong 'un. The CCTV showed the judge and I guess the jury that the girl was too drunk in their opinion to have sexual intercourse.

 

However the jury clearly decided, or the case was argued well enough, that the same CCTV evidence makes it very hard to suggest that the girl was unwillingly taken to the room.

 

However that same CCTV evidence has Evans looking like a sexual predator. Turns up alone, and then escapes through a fire door. He had no business being there.

2) Genuine knowledge about the actus reus and mens rea of rape is scarce.

 

The facts (if true as presented in the link on page whatever) show that this was NOT rape.
